Baseball Stats: Historical Data or Intellectual Property?

Are Major League Baseball statistics "historical data" which can be used at will by anyone, including fantasy leagues, or are the stats a form of "intellectual property" for which baseball has the right to demand licensing fees if used commercially?

The question is being debated in a lawsuit currently pending in the U.S. District Court in St. Louis.
